MEDICAL DISCLAIMER AND LIMITATION OF LIABILITY
The information, guidance, products, and services provided by Pelagic Medical LLC ("Pelagic Medical") are for informational and educational purposes only. Nothing provided by Pelagic Medical — including medical kits, kit contents, labeling, written protocols, training courses, physician advisory services, consultations, or any other communication — constitutes the practice of medicine, the establishment of a physician-patient relationship, or a guarantee of outcome.
No Physician-Patient Relationship. Use of any Pelagic Medical product or service does not create a physician-patient relationship between the user and Pelagic Medical, its founders, employees, contractors, or affiliated physicians. Advisory consultations are informational in nature. Participating physicians do not assume ongoing clinical responsibility for subscribers, their crew, or any individual who receives guidance through the advisory service. Patient care services are provided independently by Pelagic Medical Services PLLC
Not a Substitute for Emergency Services. Pelagic Medical products and services are not a substitute for professional emergency medical care. In any life-threatening situation, users must contact maritime rescue authorities, activate emergency signaling devices, and seek the nearest available medical care. Do not delay emergency action in order to contact Pelagic Medical.
Prescription Medications. Pelagic Medical does not prescribe, dispense, or fulfill prescription medications. Any prescription medications available as optional additions to Pelagic Medical kit configurations are prescribed, dispensed, and fulfilled exclusively through independent, licensed third-party medical and pharmacy providers. Those transactions occur under a separate physician-patient relationship established directly between the prescribing provider and the patient, and are governed by the terms, policies, and liability framework of that provider. Pelagic Medical assumes no responsibility for the prescribing, dispensing, labeling, storage, or use of any prescription medication.
Assumption of Risk. Offshore and blue-water passage-making involves inherent risks, including medical emergencies in remote locations without access to professional care. By purchasing Pelagic Medical products or subscribing to Pelagic Medical services, users acknowledge these risks and accept full responsibility for all medical decisions made aboard their vessel.
Limitation of Liability. To the fullest extent permitted by applicable law, Pelagic Medical LLC, its officers, founders, employees, contractors, and affiliated physicians shall not be liable for any injury, death, loss, or damage — direct, indirect, incidental, consequential, or otherwise — arising from the use or misuse of any Pelagic Medical product, kit, protocol, training course, advisory service, or communication. This limitation applies regardless of whether such liability is based in contract, tort, negligence, strict liability, or any other legal theory.
Training Courses. Clinical training courses provided by Pelagic Medical are educational in nature and do not confer medical licensure, certification, or clinical competency. Completion of a course does not qualify any participant to perform medical procedures in any professional or regulated capacity.
Product Use. Medical supplies and equipment included in Pelagic Medical kits are intended for use by individuals who have received appropriate training. Pelagic Medical makes no representation that any product is suitable for any specific individual, condition, or situation. Users assume all risk associated with the use of kit contents.
Governing Law. This disclaimer shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any disputes arising under or related to this disclaimer or the use of Pelagic Medical products or services shall be subject to the exclusive jurisdiction of the courts of the State of Washington.
